LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

May 24, 2005

TO:
Honorable Tom Craddick, Speaker of the House, House of Representatives

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB1209 by Gattis (Relating to using county election precincts for any election held on the November uniform election date. ), As Passed 2nd House

No fiscal implication to the State is anticipated.

The bill would establish that county election precincts, except in a county with a population of more than 3.3 million or adjacent to a county of that size, are the election precincts for any election held on the November uniform election date. The bill would require the Secretary of State to prescribe procedures for political subdivisions to follow if an election precinct is not located wholly within the territory of a political subdivision holding an election in a precinct or a district used to elect an office at the election.

The bill would take effect September 1, 2005.

The Secretary of State indicates the agency can absorb associated administrative duties within existing resources.

Local Government Impact

The provisions of the bill would apply to all counties except Harris County and the counties adjacent to Harris County. There would be no fiscal impact to the counties excluded from the provisions of the bill.

County election officials that would be affected that were contacted indicated that the provisions of the bill would have little or no fiscal impact.
