No significant fiscal implication to the State is anticipated.

The bill would require that toilets sold, distributed, or imported into Texas would retain flush volumes after flapper replacement. The bill would provide a method of ensuring that toilet water efficiency was retained with a readily available flapper that would fit the toilet and seal the tank after flushing. Manufacturers or importers would have to submit test results from an independent laboratory to verify that maximum flow does not exceed 2.0 gallons if the water level in the tank is raised to the maximum allowable height of the overflow tube. The Texas Commission on Environmental Quality (TCEQ) would administer the provisions of the bill and adopt associated rules. Any costs to the TCEQ are expected be absorbed using existing agency staff and resources.
