HB1242 by Hopson (Relating to the harassment of persons by individuals under arrest or detained by a peace officer; creating an offense.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would create as a third degree felony offense, if while under arrest or detained by a peace officer, a person with intent to harass, alarm, or annoy another person causes the other person to contact the blood, seminal fluid, vaginal fluid, saliva, urine, or feces of the actor or any other person. The bill would take effect September 1, 2005.

It is anticipated that enforcement, prosecution, and confinement of offenders as a result of implementation of the provisions within the bill would occur within existing resources.
