LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

February 21, 2005

TO:
Honorable David Swinford, Chair, House Committee on State Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB1284 by Swinford (Relating to the exception from required public disclosure of a photograph of a peace officer.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Section 552.119 of the Government Code to no longer reference an exception to disclosure for photographs of security officers commissioned under Section 51.212 of the Education Code.

The Attorney General states that any additional legal work resulting from passage of this legislation could be reasonably absorbed with current resources.  The Texas Education Agency states that the bill has no fiscal implications for either the foundation school program or the operations of the agency.

The bill would take effect immediately upon receiving a two-thirds majority vote in both houses; otherwise, the bill would take effect September 1, 2005.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.  The Texas Education Agency states that no new actions would be required of school districts.
