HB1358 by Flores (Relating to the jurisdiction of the Texas Commission on Environmental Quality over certain water supply or sewer service corporations and the creation of the La Joya Special Utility District. ), Conference Committee Report

No significant fiscal implication to the State is anticipated.

The bill would provide the Texas Commission on Environmental Quality (TCEQ) with the same jurisdiction over a water supply or sewer service corporation (WSC) as it does over an investor-owned utility if the corporation is failing to conduce annual or special meetings or is not complying with requirements for classification as a nonprofit water supply or sewer service.

The bill would also create the La Joya Water Supply Corporation and La Joya Special Utility District.

The TCEQ anticipates that the bill's provisions relating to TCEQ's jurisdiction over WSCs could increase the number of rate cases the agency handles, and passage of the bill would require rulemaking by the TCEQ. However, any increased workload is expected to be handled using existing agency resources.


Local Government Impact

No significant fiscal implication to units of local government is anticipated from the bill's provisions relating to TCEQ's jurisdiction over WSCs. Regarding the bill's provisions creating the La Joya Water Supply Corporation and La Joya Special Utility District, because these provisions would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
