No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code to entitle certain commissioned peace officers injured in the course of performance of duty to injury leave, without a deduction in salary, compensatory time, or any other type of leave.

 

Commissioned peace officers would be required to submit evidence of medical examination and recommendations for a specific period of leave from a licensed physician to the person's employer. The maximum amount of time allowed would be one year.  The bill would allow a person to simultaneously be on injury leave and receive workers compensation medical benefits, but the person would not be eligible for disability retirement benefits during the period of leave.  The bill would entitle a person to workers’ compensation indemnity benefits after the discontinuation or exhaustion of injury leave.

 

The bill would take effect immediately if it receives a vote of two-thirds of all the members elected to each house.  If the bill does not receive the vote necessary for immediate effect, the bill would take effect September 1, 2005.
