LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

March 18, 2005

TO:
Honorable Joe Driver, Chair, House Committee on Law Enforcement

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB1438 by Talton (Relating to continuing education for peace officers.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Occupations Code to require the Texas Commission on Law Enforcement Officer Standards and Education (TCLEOSE) to provide continuing education credit to peace officers that served as active members of the United States military for at least 12 months during the relevant 24-month period. The bill would also require TCLEOSE to notify, via certified mail, peace officers that are not in compliance with the continuing education requirement that a hearing will be held at the request of the peace officer if the peace officer fails to obtain the required training within 60 days after notification of noncompliance. TCLEOSE reports that the provisions of the bill would have minor impact on its current notification of noncompliant peace officers, however these costs are not estimated to be significant.

The bill would take effect immediately if a two-thirds majority vote in both houses of the Legislature is received. Otherwise, the bill would take effect on September 1, 2005.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
