No fiscal implication to the State is anticipated.
The bill would authorize a person who sells fireworks to administer a breathalyzer to their customers if the seller thinks the customer might be intoxicated, which would have no impact on a governmental entity; however, the bill would also add that selling fireworks to a person under the age of 12 or who is intoxicated would be a Class C misdemeanor. The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005.
Local Government Impact
No significant fiscal implication to units of local government is anticipated from enforcement, prosecution, and punishment of an offense.
