No fiscal implication to the State is anticipated.

The bill would require that information concerning an individual member, retiree, annuitant, or beneficiary that is contained in records maintained by the Texas County and District Retirement System (TCDRS) or maintained in the custody of another governmental entity or an administrator or carrier acting in cooperation with TCDRS, is not subject to public disclosure. The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005.

Under current statute, the information is listed as confidential under Section 552.101, Government Code, and records maintained directly by TCDRS are the only records specified to which confidentiality would apply. The proposed change in statute would ensure that all information contained in TCDRS records, regardless of where those records are maintained, is covered by confidentiality requirements. Further, all of Chapter 552, Government Code (Public Information), would apply to the records rather than only one section.

No significant fiscal implication to units of local government is anticipated.
