The bill would amend Section 791.011, Government Code, to authorize a local government to enter into an agreement for the performance of governmental functions and services with a federally recognized Indian tribe whose reservation is located within the boundaries of this state, as long as the tribe is listed by the United States secretary of the interior under 25 United States Code Section 479a-1. The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005.
Under Section 791.011 as it currently exists, a local government may enter into an interlocal agreement only with another local government. The provisions of the bill would provide another option for a local government when seeking to establish a contract for the performance of governmental functions and services under Chapter 791, Government Code.
