LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

May 18, 2005

TO:
Honorable Robert Duncan, Chair, Senate Committee on State Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB1580 by Bohac (Relating to the period for preserving precinct election records.), As Engrossed

No fiscal implication to the State is anticipated.

The bill would require an election authority to whom precinct election records are distributed to preserve the records for at least 22 months after election day. The bill would take effect September 1, 2005 and would apply to records for an election held on or after that date.

Under current statute, authorities are required to preserve precinct election records for 60 days after election day unless the election involved a federal office; those records are maintained for at least 22 months.

Local Government Impact

No significant fiscal implication to units of local government is anticipated from additional storage costs associated with preserving all precinct election records for a longer period of time than is currently required.
