FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

March 2, 2005

TO:
Honorable Ray Allen, Chair, House Committee on County Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB1650 by Dutton (Relating to prohibiting the sale of fireworks by a person under 18 years of age and to the prosecution of offenses involving fireworks.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would create as a Class C misdemeanor the act of employing or allowing a person under the age of 18 to manufacture, distribute, sell, or use fireworks. The bill would take effect on June 20, 2005 if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005 and would apply only to an offense committed on or after the effective date.

Under current statute, a person may not sell fireworks to a person under the age of 12.

It is anticipated that enforcement, prosecution, and punishment related to the offense would not have a significant fiscal impact.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
