FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

March 2, 2005

TO:
Honorable Ray Allen, Chair, House Committee on County Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB1652 by Dutton (Relating to prohibiting the sale of fireworks to a person under 18 years of age and to the penalty for the unlawful sale of fireworks to certain persons.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would prohibit the sale of or offer to sell fireworks to a person under the age of 18. The act would be a Class C misdemeanor. The bill would take effect June 20, 2005 if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005.

Under current statute, fireworks may not be sold or offered for sale to a person under the age of 12.

It is anticipated that activities associated with the enforcement, prosecution, or punishment of the offense would not create a significant fiscal impact.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
