LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

May 17, 2005

TO:
Honorable Robert Duncan, Chair, Senate Committee on State Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB1690 by Keel (Relating to common nuisance.), Committee Report 2nd House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would include a multiunit residential property in the properties that may be considered as a "common nuisance".  The bill also amends the Civil Practices and Remedies Code so that evidence must show the owner and the operator knowingly "tolerated" rather than "permitted" the nuisance to occur on the property.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
