LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

March 14, 2005

TO:
Honorable Ray Allen, Chair, House Committee on County Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB1699 by Laubenberg (Relating to the minimum amount of the salaries of county officers or employees.), As Introduced

No fiscal implication to the State is anticipated.

The bill would prohibit a county from setting the salary of county officers, including elected officers, and county employees at less than the salary amount in effect on January 1, 2005. The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005. The bill would apply only to the salary set in a county fiscal year that begins on or after the effective date.

Under current statute, the salary amount cannot be less than the salary amount in effect on January 1, 1972, and current statute does not reference the minimum salary of elected officers.

Local Government Impact

Implementation of the bill would prevent current salaries set by a county commissioners court from being reduced below existing levels. It is anticipated that the fiscal implication would not be significant.
