The bill would amend the Occupations Code to require that the Department of Insurance (department) create reasonable regulations of the storage, discharge, safe use, and oversight of fireworks. The bill would also prohibit a person from igniting fireworks within 300 feet of a residential dwelling and change from 100 feet to 300 feet the distance in which fireworks may not be ignited in relation to where flammable liquids are stored or in relation to where fireworks are stored or sold.
The bill would take effect immediately upon receiving a two-thirds majority vote in each house. If the bill does not receive a two-thirds vote in each house, the bill would take effect September 1, 2005.
The department anticipates any additional work resulting from the passage of the bill could be reasonably absorbed within current resources.
