LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

April 25, 2005

TO:
Honorable Kent Grusendorf, Chair, House Committee on Public Education

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB1758 by Olivo (Relating to school district reporting of students placed in disciplinary alternative education programs or expelled from school.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would require that disciplinary information reported to the state include an indicator of special education status at the time a placement is made.

The information required is for the most part available within current state and local data systems.  It is assumed that existing special education enrollment indicator data would be used to meet the bill’s reporting requirement until the new incident-specific indicator could be implemented under the standard Public Education Information Management System (PEIMS) revision process.

The bill would take effect immediately upon enactment with the necessary voting majorities or September 1, 2005 and would apply beginning with the 2005-06 school year.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.  School districts would be required to report the special education status of students by disciplinary incident.
