No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure as it relates to jury-recommended community supervision for defendants convicted of a state jail felony. The change in law made by this Act would apply to a defendant who on or after the effective date of this Act files the motion required for jury-recommended community supervision, regardless of whether the offense with which the defendant is charged was committed before, on, or after the effective date of this Act. The Act would take effect September 1, 2005.
It is assumed that any costs to the State resulting from the passage of the bill could be reasonably absorbed with current resources.
