No significant fiscal implication to the State is anticipated.
The bill would require additional notice requirements for applicants to the Texas Commission on Environmental Quality (TCEQ) for permits for municipal solid waste facilities. The bill would mandate that the TCEQ require an applicant for a permit, a permit amendment, and, in some cases, a permit modification to mail notice of such application to each residential or business address and to each owner of real property located within one mile of a municipal solid waste facility. Current law requires these same entities within 500 feet of a facility to be notified. The bill is not expected to have a significant impact on the TCEQ's workload.
Local Government Impact
Local governments that own municipal solid waste facilities could experience some increased costs if they request new permits or changes to existing permits. These local governments may see an increase in postage costs associated with the bill’s notification requirements. The costs are not expected to be significant.
