The bill would amend Subchapter D, Chapter 35, Business and Commerce Code by adding the new Section 35.62. which would prohibit the disclosure of an individual’s social security number to obtain goods or services or enter into a business transaction unless authorized under state or federal law. This section does not apply to a governmental entity.
The Attorney General, or county attorney, would be authorized to bring suit to recover a civil penalty not to exceed $1,000 for each violation. The Attorney General would be authorized to bring an action to restrain or enjoin a person from violating this section. It is projected that this increase could be absorbed within current resources.
This Act takes effect on September 1, 2005.
