LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

May 21, 2005

TO:
Honorable Kenneth Armbrister, Chair, Senate Committee on Natural Resources

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB1821 by Kolkhorst (Relating to the authority of a county to require waste haulers to be licensed as a waste hauler.), As Engrossed

No fiscal implication to the State is anticipated.

The bill would authorize a county to require a waste hauler that operates regularly in more than three counties to obtain a waste hauler license. A county that requires a waste hauler to be licensed may not require those persons who would no longer be exempt from licensing to possess a license prior to January 1, 2006. The bill would take effect September 1, 2005.

Under current statute, a waste hauler who regularly operates in more than three counties is exempt from having to be licensed.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
