LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

March 19, 2005

TO:
Honorable Helen Giddings, Chair, House Committee on Business & Industry

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB1870 by Turner (Relating to a deceptive trade practice in connection with advertising for a household goods carrier.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would add Section 17.46(b)(28) which makes it a deceptive trade practice if a seller of print advertising to a motor carrier registered to transport household goods does not include their certificate of registration number in their advertising.  The  Act would take effect on September 1, 2005.

The proposed legislation will likely result in new complaints, investigations and cases by the OAG, however it is projected that this increase could be absorbed by current resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
