March 21, 2005

TO:
Honorable Dennis Bonnen, Chair, House Committee on Environmental Regulation

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB1880 by Mowery (Relating to the issuance of permits affecting air quality and notification of certain local officials.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would require the Texas Commission on Environmental Quality to notify certain local elected officials when an application for air permit or permit amendment is received for a facility which is or will be located in a non-attainment area of the state. The bill would require that notification be provided to the county commissioners of the county where the facility is or will be located and to each member of the governing body of each municipality with a population of 100,000 or more which is located in the affected county. The bill provides that the notice could be sent electronically.

Any increased workload or increase in notification costs to the TCEQ resulting from the bill's passage is expected to be absorbed within existing agency resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
