No significant fiscal implication to the State is anticipated.

The bill relates to the seizure and disposition of property for the offense of hunting or fishing without landowner consent.  Under the bill, if a person is convicted of taking wildlife resources without landowner consent, the court may order the weapon or other personal property used in the commission of the offense to be destroyed or forfeited to the Texas Parks and Wildlife Department (TPWD), excluding a vehicle, aircraft, or vessel.  TPWD may sell, transfer, destroy, or use the property in the course of normal operations.  If the property is sold, the funds would be deposited to the General Revenue-Dedicated Game, Fish, and Water Safety Account No. 9.  Any property seizures or revenue from the sale of seized property resulting from passage of this bill, is not anticipated to have a significant fiscal impact on agency operations.

The bill would take effect September 1, 2005.
