No significant fiscal implication to the State is anticipated.

The bill would repeal Chapter 125, "Common and Public Nuisances," of the Civil Practice and Remedies Code and replace it with a new chapter, Chapter 138, "Nuisances." Much of the chapter that would be repealed is recodified, with minor revisions, into the proposed new chapter. New procedures and regulations within the proposed statute include authorizing an action to enjoin and abate a nuisance to be brought by the attorney general, a district attorney, county attorney, municipal attorney, or an individual.
