No significant fiscal implication to the State is anticipated.

The bill would amend Chapter 2301 of the Occupations Code related to the sale or lease of motor vehicles to allow a manufacturer or distributor to own an interest of less than 35 percent in an entity that holds a general distinguishing number (motor vehicle dealer) if the manufacturer had the ownership interest on or before September 1, 1999, and the entity operates as a dealer for buses that have a gross vehicle weight of at least 17,500 pounds, are designed to carry at least 17 seated passengers, are not motor homes, and are sold exclusively for commercial use; and the entity is the exclusive seller in the United States for the bus and is not operated or controlled by the manufacturer or distributor.

Based on the analysis of the Texas Department of Transportation, it is assumed any duties associated with implementing the provisions of the bill could be absorbed within existing resources.

The bill would take effect on September 1, 2005.
