No significant fiscal implication to the State is anticipated.
The bill would add a section to the Occupations Code to prohibit a motion picture theater from showing a picture trailer that is a more restrictive rating than that of the main feature. A person who violates the requirements would be liable to the state for a civil penalty in an amount not to exceed $5,000 for each violation. The penalty may be recovered in a suit brought by the county attorney of the county in which the violation is alleged to have occurred. The bill would take effect September 1, 2005.
