HB2199 by Madden (Relating to the salaries of a county elections administrator and the administrator's employees.), Committee Report 2nd House, As Amended

No fiscal implication to the State is anticipated.

The bill would repeal Section 31.039(b), Election Code, which is the requirement that a county elections administrator may not be paid more than the county clerk and that the elections administrator's employees may not be paid more than the county clerk's employees in comparable positions.

The bill would add Chapter 9303 to the Special District Local Laws Code to establish administrative procedures and voter eligibility related to the El Paso County Water Improvement District No. 1.

The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005.


Local Government Impact

Repealing Section 31.039(b) would provide flexibility to a county to establish its own pay structure for an elections administrator and their staff. No significant fiscal implication on units of local government is anticipated.

Because the provision related to the El Paso County Water Improvement District would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
