No fiscal implication to the State is anticipated.

The bill would amend the Property Code as it relates to the operation of property owners' associations, including prohibiting, except as provided by a restriction created prior to September 1, 2003, an association from foreclosing a property owners' association's assessment lien unless the association first obtains a court judgment foreclosing the lien and providing for issuance of an order of sale.


Local Government Impact

A property owners' association is not a government entity. A court in which a judgment is sought would not experience a significant fiscal impact from the addition of any applicable cases filed.
