LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

April 4, 2005

TO:
Honorable Harold V. Dutton, Jr., Chair, House Committee on Juvenile Justice & Family Issues

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB2231 by Reyna (Relating to the payment of child support to an individual with actual primary possession of the child.), Committee Report 1st House, Substituted

No fiscal implication to the State is anticipated.

The bill amends the Family Code, changing the court’s task, from "may" to "shall", on the motion of the obligor or the person in possession of the child to modify who the obligee is if the existing obligee has voluntarily surrendered possession of the child for at least six months.  The Office of the Attorney General (OAG) reports the bill would exclude the agency from filing pleadings for a change of status and would present an impediment from the OAG working on these cases and redirecting the money to the appropriate person.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
