HB2246 by Hegar (Relating to the amount of damages offered to a real property owner by an entity exercising the power of eminent domain.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would require a condeming entity to provide to a property owner a written estimate of the value that will be offered to the owner for the property interest to be acquired through eminent domain in addition to the appraisal reports currently required by law.

Based on the analysis of the Texas Department of Transportation, the University of Texas System, the Texas A&M University System, and the Office of the Attorney General, it is assumed any duties and responsibilities associated with implementing the provisions of the bill could be acomplished by utilizing existing resources.

The bill would take effect on September 1, 2005.
