LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

March 31, 2005

TO:
Honorable Mike Krusee, Chair, House Committee on Transportation

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB2257 by Gallego (Relating to the speed limit on a highway in a rural area.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to increase from 75 to 80 miles-per-hour the existing maximum daytime speed limit on certain portions of the state highway system. The Texas Transportation Commission would have to determine that is would be a safe and reasonable speed for that part of the highway system and that portion of the system would have to be located in a county with a population density of less than 10 persons per square mile.

Based on the analysis of the Texas Department of Transportation, it is assumed any costs and duties associated with implementing the provisions of the bill could be absorbed within existing resources.

The bill would take effect immediately upon receiving a vote of two-thirds of all members elected to each house or otherwise on September 1, 2005.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
