No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure by making the offense of obscenity a reportable conviction under the sex offender registration program if the offense is punishable as a felony of the third degree. The bill also specifies that the duty to register for persons identified by the bill would end when the person dies. For fiscal year 2004, one person was admitted to the Texas Department of Criminal Justice and two persons were placed on community supervision for the offense of obscenity punishable as a third degree felony. Therefore, it is assumed that the number of offenders affected by this bill would not result in a significant impact on the programs and workload of state corrections agencies or on the demand for resources and services of those agencies.
