April 9, 2005

TO:
Honorable Helen Giddings, Chair, House Committee on Business & Industry

FROM:

IN RE:
HB2289 by King, Tracy (Relating to required notice of and a lien resulting from damage to a fence.), As Introduced

No fiscal implication to the State is anticipated.

The bill would require a peace officer employed by a political subdivision who investigates or responds to an incident in which a motor vehicle damages a property owner's fence, to determine who the property owner is and to immediately notify the owner about the damage to the fence, provided that the officer reasonably believes the fence is intended to contain livestock or other animals. The bill would take effect September 1, 2005 and would apply only to damage from an incident that occurs on or after that date.

Local Government Impact
