No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure to require under certain circumstances a magistrate to order the destruction of a seized weapon or forfeiture of the weapon to the state for use by the law enforcement agency holding the weapon. The bill would add that if a person found in possession of a weapon receives deferred adjudication for an offense involving the use of a weapon, that person's seized weapon shall be ordered destroyed or forfeited. The bill would take effect September 1, 2005 and would apply only to a weapon seized on or after that date.
