No significant fiscal implication to the State is anticipated.

The bill would amend the Education and Occupations Codes relating to certain duties of state agencies with regard to members of the United States armed forces and their dependents and the communities in which they reside.

Section 3 of the bill as substituted, which would direct the State Board for Educator Certification (SBEC) to issue a temporary certificate at a reduced fee to an applicant who is a military dependent, could conflict with Texas Education Code section 21.041, which requires SBEC to propose rules adopting fees for an educator certificate adequate to cover the cost of administration by the agency.  According the SBEC, the reduced fee would not be adequate to cover the cost of services rendered.  However, the number of applicants under this section is likely to be small, and it is assumed for the purposes of this fiscal note that any administrative costs not covered by the reduced fee under this section would be covered with other revenue available to the agency.

Section 4 of the bill as substituted states that certain military personnel who return from active duty would not be required to reside in the state for at least 12 months immediately preceding the date of the person's registration at an institution of higher education to be eligible for tuition and fee exemptions as long as the other residency requirements under Section 54.203 of the Education Code are met.

Based on the analysis of the State Board for Educator Certification, Higher Education Coordinating Board, and the Real Estate Commission, any additional costs, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.

The bill would take effect September 1, 2005
