LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

May 3, 2005

TO:
Honorable Joe Nixon, Chair, House Committee on Civil Practices

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB2346 by Raymond (Relating to requiring courts to report the number of frivolous lawsuits filed each year.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would require courts to report the number of frivolous lawsuits filed each year to the Office of Court Administration (OCA).  The bill would require OCA to file an annual report of litigants signing frivolous proceedings to the State Bar for appropriate disciplinary action, if any.  OCA indicates the new duties under the bill could be absorbed within existing resources.

Local Government Impact

To the extent the bill would require courts to provide additional information in reports submitted to the OCA, no significant fiscal implication to units of local governments is anticipated.
