LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

April 5, 2005

TO:
Honorable Harold V. Dutton, Jr., Chair, House Committee on Juvenile Justice & Family Issues

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB2351 by Raymond (Relating to a release of a child support lien.), As Introduced

No fiscal implication to the State is anticipated.

The bill amends the Family Code to make clear that a release is mandatory if the claimant has executed a satisfaction of judgment for the amounts otherwise owed.  The bill would require a release of lien to be delivered to the IV-D agency (even if not involved in the suit affecting the parent child relationship) and requires that the release "specifically state the amount of child support that was paid by the obligor on or before the date the release is signed, and indicate whether that amount is inclusive or exclusive of interest."  The Office of the Attorney General does not anticipate any cost associated with this bill.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
