The bill would prohibit a groundwater conservation district from promulgating rules that would discriminate between owners of land that is irrigated for production and owners of land or their lessees and assigns whose land was irrigated for production that is enrolled or participating in a federal conservation program. A district would be prohibited from discriminating when issuing a permit, as well.
The bill would add the operation of wells to those activities for which a district shall require a permit and would add to the information that must be included in a permit application. A permit amendment would be required if there is a change in the purpose and place of use under a permit that was granted for historic or existing use.
The bill would take effect September 1, 2005.
