LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

April 27, 2005

TO:
Honorable Dennis Bonnen, Chair, House Committee on Environmental Regulation

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB2455 by Talton (Relating to the elements of the criminal offense of discharging used oil into water in the state. ), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would create an exception to what constitutes an offense for causing or threatening to cause water pollution for the discharge of oil into state waters if the concentration of the oil in the waste stream is less than 15 parts per million after the discharge and the person has a storm water permit from the Texas Commission on Environmental Quality (TCEQ). The bill also would allow the intentional discharge of used oil into a sewer, drainage system, septic tank, surface water, groundwater, water course, or marine water as long as the concentration of oil in the waste stream as it enters water is less than 15 parts per million following the discharge and the person has a stormwater permit from the TCEQ.

It is not expected that the bill's passage would have a significant impact on the TCEQ's workload.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
