IN RE:	HB2456 by Talton (Relating to restrictions on the transfer of a fuel tank to a metal recycling entity.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would provide an exception from the prohibition on disposal of scrap fuel tanks that have been completely drained and rendered unusable. The Texas Commission on Environmental Quality would be required to adopt standards which would define fuel tanks that are completely drained and rendered unusable. The change in the law would be effective for the sale or transfer of a fuel tank to a metal recycling entity on or after January 1, 2006.

Any costs to the Texas Commission on Environmental Quality would be absorbed using existing agency resources.

Local Government Impact

A local government that otherwise would have to pay the cost of disposing of a fuel tank could experience a savings as a result of the bill's passage, since the bill would offer a recycling option, which could prove to be less costly than disposal. The savings would depend on the number of fuel tanks being disposed of.
