No fiscal implication to the State is anticipated.
The bill would amend Chapter 97, Civil Practice and Remedies Code by adding Section 97.003 which would limit civil liability claims against nonprofit agencies that provide child welfare services through performance-based contracts on behalf of the state to children in the conservatorship of the state. The limitation on civil liability would not apply to reckless conduct or intentional, willful, or wanton misconduct of a nonprofit agency.
