April 27, 2005

TO:
Honorable Mary Denny, Chair, House Committee on Elections

FROM:

IN RE:
HB2487 by Gonzalez Toureilles (Relating to the award of attorney's fees in an election contest.), As Introduced

No fiscal implication to the State is anticipated.

The bill would authorize a district court to dismiss a petition contesting an election if it is determined that the contestant’s petition is frivolous.  If a contestant’s petition is found to be frivolous, the bill would authorize the district court to order the contestant to pay reasonable attorney’s fees of the contestee.  Because the bill would amend provisions relating to procedures and fee awards in an election contests, no fiscal implication to the State is anticipated.

Local Government Impact

No fiscal implication to units of local government is anticipated.
