No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to prohibit the Texas Department of Transportation (TxDOT) from constructing or operating a toll road if the agency used any public money, including monies from the Texas Mobility Fund and the State Highway Fund, to pay for right of way; or used public money for the acquisition, construction, maintenance, extension, expansion, or operation of the highway. The bill would prohibit TxDOT from conveying such a facility to another entity to operate as a toll road.

The bill would repeal various sections of the Transportation Code related to the conversion of state highways to toll roads.

The bill would take effect immediately upon receiving a vote of two-thirds of all members elected to each house or otherwise on September 1, 2005.

Based on the analysis of TxDOT, it is assumed any costs associated with implementing the provisions of the bill could be absorbed within existing resources.
