LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

March 16, 2005

TO:
Honorable Terry Keel, Chair, House Committee on Criminal Jurisprudence

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB2504 by Uresti (Relating to the performance of community service as a condition for a deferral of adjudication in a misdemeanor traffic case punishable by fine only.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure to allow a defendant charged with a traffic offense and who is required to work community service work, regardless of whether the defendant is a resident of Texas, to elect whether to perform that work in a county in which the court is located or in the county or parish in which the defendant resides. The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
