The bill would allow a person to sell or otherwise disclose a consumer’s personal information if: the person making the disclosure pays the consumer $5 for each person to whom they disclose the consumer’s information; the consumer waives compensation before each disclosure; or, the person provides the consumer with a privacy policy, has the consumers authorization, and the person whom the information is disclosed agrees in writing not to disclose the consumer’s personal information.
A person who violates this section shall compensate the consumer by paying them $5 per disclosure. This section does not apply to: a governmental entity; information that cannot be used to contact the consumer; disclosure for purposes of providing a consumer goods or services requested by the consumer; or, information disclosed in a publicly available directory.
This Act takes effect on September 1, 2005.
The proposed legislation may result in new complaints, investigations or cases by the Office of the Attorney General, however, it is projected that this increase can be absorbed by current resources.
