No significant fiscal implication to the State is anticipated.

The bill would authorize mental retardation authorities to provide Intermediate Care Facilities for Persons with Mental Retardation (ICF/MR) and related waiver services if the authority complies with capacity limitations and it is necessary to ensure the availability of services. The bill would require the Executive Commissioner of the Health and Human Services Commission to adopt rules to establish the roles and responsibilities of local mental retardation authorities.
