The bill would authorize mental retardation authorities to provide Intermediate Care Facilities for Persons with Mental Retardation (ICF/MR) and related waiver services if the authority complies with capacity limitations or it is necessary to ensure the availability of services. The bill would require the Executive Commissioner of the Health and Human Services Commission to adopt rules to establish the roles and responsibilities of local mental retardation authorities. The bill would delete provisions relating to local authorities as providers of last resort and would authorize local mental health authorities to serve as qualified service providers.
The bill would require the Department of State Health Services (DSHS) to approve a local authority's request to develop an integrated physical health and behavioral health service delivery model in partnership with a public hospital, county health department, or other governmental entity. The bill would authorize a public hospital, county health department, or other governmental entity under contract with the DSHS to provide primary health care services and behavioral care services to enhance the integration of care. Implementation of an integrated health service delivery model may have a fiscal impact on local authorities and local units of government. It is assumed that an integrated health service delivery model would not result in increased costs to DSHS.
