LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

May 19, 2005

TO:
Honorable Troy Fraser, Chair, Senate Committee on Business & Commerce

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB2716 by Swinford (Relating to equal employment opportunity reports.), As Engrossed

No significant fiscal implication to the State is anticipated.

The provisions of the bill amend the Government Code to require state agency annual reports on equal employment opportunities which are currently being sent to the governor, be sent instead to the Texas Workforce Commission (TWC) Civil Rights Division. The Civil Rights Division is required to compile these reports and file them with the governor and the legislature. This report can either be made separately or as part of any other report to the legislature.

The report is due not later than November 1 of each year and the information reported shall be for the preceding fiscal year.

TWC and the Office of the Governor anticipate any additional work resulting from the passage of the bill could be reasonably absorbed within current resources.

The bill would take effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If the bill does not receive the vote necessary for immediate effect, the bill would take effect September 1, 2005.

Local Government Impact

No fiscal implication to units of local government is anticipated.
