No fiscal implication to the State is anticipated.
The bill would amend Chapter 241 of the Health and Safety Code to expand the definition of "legally authorized representative" under the Texas Hospital Licensing Law. The new definition would include persons authorized to consent to medical treatment on behalf of the patient under Chapter 313, an heir of the patient if the patient is deceased, and persons exersizing powers granted by a statutory durable power of attorney signed by the patient as principal. The Department of State Health Services indicates there would be no fiscal impact.
